“BLUE MAN GROUP FLY AWAY” SWEEPSTAKES OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. “Blue Man Group Fly Away” Sweepstakes (“Sweepstakes”) and these official rules are governed, construed and interpreted under the laws of the United States. Valid only to legal residents of the 50 United States and the District of Columbia who are twenty one (21) years of age and older. All federal, state, local laws and regulations apply. Void outside of the 50 US and DC, and where prohibited, taxed, licensed or restricted by law.
PROMOTION PERIOD. This Sweepstakes begins at 12:01am PACIFIC STANDARD TIME (PST) on March 19, 2008 and ends at 11:59pm (PST) on April 11, 2008, (“Sweepstakes Period”). This sweepstakes is sponsored and administered by Rhino Entertainment Company, d/b/a Rhino Entertainment Company (“Rhino”). Participants agree to be bound by these official rules and the final decision of Rhino.
ENTER ON-LINE ONLY BY: Accessing the Rhino page on the World Wide Web at www.rhino.com/bluemangroup, during the Sweepstakes Period. Click on the designated icon and follow the on-screen instructions and enter your contact information. You will be prompted to input, in the spaces provided, your first name, middle initial, last name, street address (no P. O. Box number accepted), city, state, zip code, e-mail address, date of birth and telephone number. Then, click the designated icon to forward your entry. Limit one (1) entry per person/address/email address. Rhino's computer will be the official time clock for the Sweepstakes. Any attempt by any person to obtain more than the stated number of entries by using multiple/different email or wireless accounts or any other methods will void all of that person's entries and that person will be disqualified.
ALL ENTRIES MUST BE RECEIVED BY NO LATER THAN 11:59 PM (PST) ON April 11, 2008.
DRAWING. The Winner will be randomly selected from all eligible entries received. The random draw will be held on or about April 14, 2008. Odds of being randomly selected are determined by the number of eligible entries received during the Sweepstakes Period. Only one (1) entry per person. All entries and their content become property of Rhino and will not be acknowledged or returned. All entries submitted will be used for the purpose of selecting a winner as described in these Official Rules.
Rhino will award one (1) Grand Prize. If a prospective prizewinner is found ineligible or fails to comply with the official rules, his/her claim to a prize is forfeited and an alternate winner will be randomly selected.
PRIZE:
One (1) Grand Prize. Grand Prize winner will receive two (2) tickets to see Blue Man Group perform at the Venetian Resort Hotel Casino prior to September 30, 2008 (blackout dates may apply subject to Rhino's sole discretion), 20080 in Las Vegas, Nevada, two (2) coach class roundtrip airfares for two people from a major airport nearest the Grand Prize winner's city and state of residence to Las Vegas, Nevada, one (1) hotel room (single room, double occupancy) at the Venetian Hotel Resort Casino in Las Vegas, Nevada for two (2) nights sometime prior to September 30, 2008 (blackout dates may apply subject to Rhino's sole discretion), an exclusive meet and greet photo opportunity with Blue Man Group, and One Hundred U.S. Dollars ($100.00) spending money. Total Approximate Retail Value (“ARV”) of Grand Prize: $2,500.00. Prize value may vary depending upon point of departure, departure date, time of travel and airfare fluctuations. Any difference between stated “ARV” and actual value of trip will not be awarded. Changes to trip itinerary may not be made once the trip is booked. All travel and accommodations are subject to change and availability. Rhino is not liable for any expenses incurred as a consequence of a flight cancellation or flight delay. Schedules are subject to change without notice. Other restrictions and blackout dates may apply. Travel/hotel accommodations and transportation arrangements are at the sole discretion of Rhino. Airline carrier and hotel regulations and conditions apply. If Grand Prize winner is unable to travel on dates specified by Rhino, the Grand Prize will be forfeited in its entirety, and an alternate winner may be chosen, provided sufficient time remains to verify alternate winner and ticket prize, otherwise the Grand Prize will not be awarded. Grand Prize winner and travel companion must travel together on same itinerary and comply with all airport and venue security requirements. Travel companion of Grand Prize Winner must be 21 years of age or older as of the date of departure. No responsibility is assumed for any cancellation or rescheduling of the concert, in whole or in part. In the event the concert is cancelled or postponed for any reason, awarding the remaining elements of prize shall constitute full satisfaction of Rhino's prize obligation to Grand Prize winner and no substitute or additional compensation will be awarded.
WINNER IS RESPONSIBLE FOR ALL TAXES, FEES, SURCHARGES, PASSPORTS, INSURANCE, GROUND TRANSPORTATION, MEALS, GRATUITIES, PERSONAL EXPENSES, INCIDENTALS AND OTHER EXPENSES NOT EXPRESSLY LISTED ABOVE.
The potential prizewinner will be notified by email at the email address provided with the entry form on or around April 1, 2008. Prize will not be fulfilled outside the 50 Unites States of District of Columbia. Prizewinner will be required to execute an Affidavit of Eligibility and Publicity/Liability Release, where lawful, which must be returned within two (2) days of attempted prize notification. If documents are not returned on a timely basis, or if prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these official rules, such prize will be forfeited and awarded to an alternate winner. There is no substitution for any prize or portion thereof, except due to unavailability for any reason, in which case a prize of equal or greater value will be awarded at the sole discretion of Rhino. The prize is not transferable, assignable or redeemable for cash. The prizewinner will be fully responsible for any and all federal, state and local taxes.
GENERAL CONDITIONS. Rhino, its Internet, product and service providers and their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, directors, officers, employees, agents, independent contractors and advertising and promotion agencies make no warranties, express or implied.
Employees and their immediate families of Rhino, The Venetian Resort Hotel Casino, Emery Entertainment, Inc. and Pacific Arts Entertainment, LLC, its respective Internet, product and service providers, and their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, directors, officers, employees, agents, independent contractors and advertising and promotion agencies (collectively, the “Sweepstakes Entities”) are not eligible to enter this Sweepstakes.
PRIVACY STATEMENT: Your personal information, in conjunction with this Sweepstakes, will be utilized by Rhino for the sole purpose of selecting a prizewinner and will be kept only as long as required by law. Unless otherwise authorized by you, your information will not be sold, rented or given to any other third party. Notwithstanding the privacy statement and policy, if selected as the prize winner, prize winner agrees, except where prohibited, to grant Rhino and its parent companies, subsidiaries, franchisees, affiliates, licensees and agents to use his/her name, entry contents, visual and audio likeness, biographical data and statements for any purpose, including but not limited to any commercial or publicity purpose, in perpetuity and throughout the universe, in any and all media now known or hereafter devised, without further notice or additional compensation or consideration.
LIMITATIONS OF LIABILITY. By participating, entrants, winners and travel companions, and each of their agents, assigns and successors release the Sweepstakes Entities from any and all liability for any costs or expenses including without limitation, property damage, personal injury and/or death, resulting from entry in the Sweepstakes or any Sweepstakes-related activity and from any and all liability for any injuries, losses or damages of any kind caused by any prize, or any portion of prize, including any and all travel, or resulting from acceptance, possession, quality, use or misuse of any prize, or any portion of the prize, or parts thereof and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.
The Sweepstakes Entities are not responsible for any kind of computer transmission, electronic, hardware, internet, software, network, technical or telephone failures and any damaged, delayed, garbled, illegible, incomplete, late, lost, misaddressed, misdirected, stolen e-mail. In addition, the Sweepstakes Entities are not responsible if the Sweepstakes cannot take place or if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the e-mail account. The “authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address.
Participant agrees that by entering this Sweepstakes, the Sweepstakes Entities may seek damages from participant if participant deliberately damages the Rhino.com website or any other website in conjunction with participant's partaking in this Sweepstakes or if participant interferes with the legitimate operation of this Sweepstakes, in violation of civil or criminal law.
If, in Rhino's exclusive judgment, this Sweepstakes becomes compromised in any way, Rhino reserves the right to withdraw the Sweepstakes offer, cancel any method of entry and/or select the prize winners from all entries received prior to the withdrawal.
IN NO EVENT WILL THE SWEEPSTAKES ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SWEEPSTAKES WEB SITE OR ANY OTHER WEB SITE ASSOCIATED WITH THIS SWEEPSTAKES. DISPUTES. THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Los Angeles County, California, having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
